We successfully defended the registration of the contested part of our client’s trademark before the Appeals Council. Previously, a third party had filed an opposition seeking to invalidate the trademark registration in respect of certain goods. Following the review, the Appeals Council rejected the opposition and upheld the trademark registration for the contested goods. It is important to note that even a partial loss of trademark rights may significantly affect a company’s business operations. Regular audits of the trademark portfolio are recommended, as in practice it is common to identify goods that are actually used in commerce but are not covered by the registration. In such cases, new applications should be filed without delay to expand the scope of legal protection.
