EURASIAN PATENT FOR INDUSTRIAL DESIGN BECOMES AVAILABLE
Eurasian patent for industrial design is now available for applicants

The need to expand the Eurasian system of protection of industrial property objects led to the development of the Protocol to the Eurasian Patent Convention of September 9, 1994, on The Protection of Industrial Designs (hereinafter – the Protocol). By Decree of the Government of the Republic of Kazakhstan dated September 5, 2019 No. 662, draft Protocol was approved and signed. Now, by analogy with the Eurasian patent for invention, industrial design applicants will also be able to obtain a Eurasian patent for industrial design. At the same time, the right of the applicants to submit a national application for industrial design has retained.

The application is submitted directly to the Eurasian Patent Office, or to the national office of the applicant. The Eurasian patent for an industrial design shall be valid simultaneously in the territory of the following states that have signed the Protocol: Kazakhstan, Kyrgyzstan, Tajikistan, Turkmenistan, Azerbaijan, Belarus, Russia, Armenia.

The applicant can be either an individual – the author of industrial design or his assignee. Eurasian design patent certifies authorship, priority, and exclusive right to industrial design. The patent is valid for 5 years from the filing date of the application with the right to renew each time for 5 years until the total validity of the patent shall reach 25 years.
